Why didn the mediated agreement work?
Ask the Mercers. I honored my part at all times. The Mercers must have thought that having their fingers crossed when they signed the mediated agreement meant that it didn’t count (like a 5 year old). The Mercers started cheating on the mediated agreement in just 34 days after signing it. And continued to cheat for the next 3 years until they totally gave up even pretending to honor the agreement in 2004.
