The contractor or subcontractor does not determine the rate of pay on public works projects. The Prevailing Wage rate is a predetermined hourly wage including fringe benefits for the classification of work performed. Davis Bacon wages are set by the U.S. Department of Labor. State wages are determined in Illinois by the Illinois Department of Labor and in Indiana a wage setting hearing is convened for each project bid by the public body i.e. school, village, county etc. The Indiana Department of Labor oversees this process.
