Lawyers for Dr. Azad Anand argued before the state’s highest court Tuesday that Anand’s longtime friend and links partner, Dr. Anoop Kapoor, should have to compensate for Anand’s lost wages after Kapoor’s golf shot inadvertently struck Anand in the head, blinding him in one eye. The Court of Appeals is expected to rule within the next month whether Kapoor was legally bound to yell “Fore!” before taking the shot on a Long Island course in October 2002. Anand’s lawyer, Steven Cohn, says Anand was in a “foreseeable danger zone” before Kapoor took the shot and that Kapoor should have yelled “Fore!” He said the customary warning should have be yelled even though Anand was allegedly standing at least 15 to 20 yards away and at an angle of at least 50 degrees from the intended line of flight of Kapoor’s shot.
