Where do i stand without a contract of employment?
First of all an employer must provide all employees with a wage slip. If not they are breaking the law. The problem with the DOB on your P60 can be solved by calling your local tax office, you’ll find their number in the yellow pages. I’m pretty sure that an employer has to provide a contract of employment within the first 4 to 6 weeks of employment. If there is an HR department contact them and make sure you get that sorted. Not only does that protect your rights it protects your employers too. My advice is if you want to really know your rights is to seek advice from ACAS, either call them or visit their website and they can help you with everything. I know it’s only a part time job, but you are still entitled to respect and have as much rights as anyone else.
Try taking a look at the link below to the directgov website, it gives you advice on any grievance you may have at work and you can also search on here about your employment rights. Also might be helpful to contact ACAS, this is a free phone number and they can give you confidential advice regarding your situation. I completely sympathise with you, I work in a pub on weekends, and when you’re working in that type of environment then banter and mickey taking can be considered part of the job, however it can make you feel really uncomfortable and is not really professional. I know it’s difficult but by laughing the comments off then you will probably end up with less aggravation in the long run. This is the link to the website http://www.direct.gov.uk/en/Employment/R… and the number for ACAS is 08457 47 47 47 hope things work out well for you!
You are clearly in England, judging by the language used. You actually do have a contract. You just don’t have a WRITTEN contract. Your contract is fulfilled by deeds on both sides(you turn up, work, and get paid) rather than one which you signed. But legally it is worth the same as if it was written down. If information on your P60 is wrong, contact HMRC and make sure they get it right. As for the rest of it, try fighting back. People in situations like kitchens, and close knit working groups, enjoy some banter. They may enjoy the fun of getting an insult from you. It may also prompt them to leave you alone and target someone else.
