What is unlawful search and seizure?
Unlawful search and seizure is a violation of the Fourth Amendment, which protects rights against search and seizure without a valid search warrant based on probable cause. If a law enforcement officer appears at your door and asks to search your home, you have the right to see the warrant authorizing the search. In most circumstances, if there is no warrant, the search may only occur if the person consents to it. Numerous court rulings define and determine what constitutes an illegal search and seizure.
