What is the departments procedure upon receiving a complaint?
When we receive an air quality complaint, we try very hard to respond to it within 24 hours although most responses are much sooner than that. In order to be most effective, it’s important that we receive a complaint as soon as the problem occurs, if possible, so we can observe it in progress. Someone from our staff will respond to the scene of the complaint and investigate the source of the complaint to determine if any air quality regulations have been violated. Assuming a regulation has been violated, the offender could receive a “Notice of Non-compliance” for a minor violation. More serious violations are referred to KDHE for review and possible enforcement action. KDHE has the authority to issue a monetary fine against the offender if they find the violation is severe or is a repeat violation.
