It is uncertain what the approach is to liability in respect of historic contamination. However, disposal of industrial wastes on land, other than at approved sites, is illegal in Dubai. All contaminated land or land suspected of contamination by nature of its former uses shall be investigated to determine the extent of contamination in the soil and ground water. A soil survey shall be conducted to identify the presence and concentrations of contaminants. The history of the site and the adjacent unaffected area shall be used as a benchmark in interpreting the extent of contamination of the affected area.
