What happens if a child breaches an ASBO?
Breach is a criminal offence and the case will be referred to the procurator fiscal who will determine, in consultation with the childrens reporter, what action is most appropriate. A decision will be made on whether the case should be dealt with in court or if it should be referred to the childrens hearing system. A child cannot be imprisoned or made subject to detention for breach of an order.
