US employer obtains a prevailing wage (salary) rate for the job being offered to you from SESA (State Employment Security Agency) or some other source acceptable to U.S. Department of Labor. c. US employer files an LCA (Labor Condition Application) with US Department of Labor d. US employer files an H-1B petition with the U.S. Immigration Office If you are in the U.S., the petition would be for change of your current status to an H-1B. However, if you are already on an H-1B status with an other employer, then the petition would for amendment of the employer’s name. If you are outside the U.S., the US Immigration Office will forward approved H-1B petition to U.S. Consulate/Embassy in your country which will interview you.
