Sometimes. Copyright laws usually govern software but in some cases the ideas behind the software, that is the process, or series of steps performed to achieve a result, are patentable. A patentable invention may include software code. Should all Software which could be patented actually be patented? No, it should not be patented unless it is truly unique and has the potential to generate significant income. Are Algorithms patentable? Yes, they can constitute the very method that is patented. It is really only mathematical procedures and formulas that are not patentable by themselves, but they can be patented as part of a software system or method.
