Is funding allowed through conditional or contingency fees and, if so, on what conditions?
Both the Lawyers Law and the Provisional Lawyer’s Charges Measures are silent on whether conditional or contingency fees are allowed in the PRC. However, when we contacted the Ministry of Justice on this issue they declined to provide an opinion, either in favour of or in opposition to contingent fees. In practice, contingent fees are very common. As the law is silent on the issue, no limitations or conditions are imposed. However, it can be assumed that public policy would not support exorbitant contingent fee arrangements.
