How often should the case weights be updated?
Workload standards developed through a rigorous weighted caseload study should be accurate for many years; however, periodic updating is necessary to ensure that the standards continue to accurately represent judicial workload. Increased efficiency, statutory or procedural changes, or implementation of caseflow management initiatives over time may result in significant changes in case processing. At a base level, the weights should be reviewed annually to account for legislative or procedural changes that occurred over the previous year that affect the manner in which cases are handled. One approach is to convene a committee of judges and conduct a Delphi session that relies on expert opinions to revise workload standards instead of conducting a time study. If additional data is needed, there are more comprehensive techniques that can be undertaken.
