Can the employer be penalized?

The Workers Compensation Act permits WorkSafeBC to impose an administrative penalty against an employer, up to a maximum of $500,000, in specific circumstances described in section 196 of the Act. Alternatively, an employer may be prosecuted in provincial court for a violation of the Workers Compensation Act. Individuals are not subject to administrative penalties but can be prosecuted for an offence under the Act.

Chosen by Asker Well, the employer isn’t going to be penalized. But, an individual plan does NOT have to insure you. AND, if you have stuff wrong with you, they’ll either flat out refuse to cover you, or exclude coverage for the stuff wrong with you already, or triple/quadruple the rate, or even higher. Plus, you’re not going to get maternity coverage on an individual plan, without paying hundreds extra PER MONTH, per person. No penalty to the employer. Massive penalty to the individual. LIkely, the two that want to move, want to move because they’re healthy and don’t have stuff wrong, so the individual policy would be cheaper. But the two that don’t, likely are older or unhealthy, or uninsurable. Once the ‘two’ move off, it’s highly possible there won’t be enough employees for a group plan. Which would be a major problem, for the two unhealthy/older ones.
