Are Joint Wills Valid?

Generally, each spouse should have their own Will. However, sometimes two spouses will sign the same Will, intending that such a Will: • cover all of their combined property, and • not be subject to revocation upon the death of the first spouse to die. While such Joint Wills are not invalid per se, the adoption of a joint Will does not necessarily mean that it cannot be revoked by the surviving spouse.
