The 10th Amendment states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” Unfortunately, the Constitution does not provide any implementing language for this amendment. Judicial actions, in particular, have repeatedly refused the states the right to establish laws on matters not addressed in the Constitution. This amendment would provide that implementing language.
