People get very confused with the term constructive dismissal. The actual definition of a constructive dismissal is ‘termination of a contract of employment by the employee because his employer has shown that he is unwilling to be bound by some fundamental term to the contract’. I very much doubt that you have a right under your contract to demand voluntary redundancy and even if you did it is doubtful that it would be considered as a fundamental term to the contract. As such I would not be threatening constructive dismissal. On a practical side though if your company is making redundancies it may well be glad of your volunteering to be made redundant, and you never have anything to lose by asking…. the worst they can do is say no.
