Would home rule affect the pollution abatement order currently in force at Lake Chaffee?
There is nothing in the statutes to indicate home rule would affect the abatement order. The status of the order ultimately rests with the Department of Environmental Protection (DEP) commissioner, who has discretion over whether, and how, to enforce it. DEP is currently holding the order in abeyance. LCIA, the town of Ashford, and the DEP all signed a consent order in 1992 regarding pollution from failing septic systems around the lake. The order required (1) a preliminary study, (2) a comprehensive engineering study, and (3) pollution “corrective measures” to be taken based on the studies.
