If the physician has the direct treatment relationship it would be assumed, after compliance date, that they already have provided notice and have an acknowledgement. Thus it isn’t necessary for them to complete anything differently for the death certificate. Of course they should treat the death certificate as a form of PHI. If you are referring to a physician who is completing a death certificate for someone who is not his/her patient, remember the new law calls for Notice only when the physician has a direct treating relationship. If they were called in just to pronounce death no notice is needed.
