No. Although the European Council of Employment Ministers had agreed to end resident on-call time being counted as work and to make compensatory rest breaks more flexible. However, the European Parliament voted to block the proposed amendments to the Directive. Conciliation negotiations between the Council and the Parliament were unsuccessful. Employers should continue to plan to implement the EWTD for doctors in training based on current legal interpretations. It will be several months before serious negotiations can resume because a new European Parliament is being elected this year. The Government has retained the right of individuals to opt-out of the maximum working hours ceiling.
