Will Insurance Compny Cover third party liability for my freind who was charged &fined for negligent driving?
This is a tricky one. Your friend had pleaded guilty, so most likely in MACT his negligence would be considered, unless there is a substantial evidence on the fault of other driver, in this case defense might work as other vehicles driver does not have effective driving licence. Many times such cases fall under contributory negligence. Also to remember, criminal court judgements are not binding on civil or MACT. You need to find the details in the police report (most of the time police would blame it on the bigger vehicle) how the collision has happened. If it is head-on generally speaking insurance company would consider it as a contributory. Even if the negligence of your friend is proved in MACT court because he pleaded guilty, insurance company is bound to honour the policy and pay the compensation awarded.
