I’ve never heard of that happening to anyone. Just to be safe, make sure you replace the drive you have with the same drive manufacturer (ex: if you’ve got a Samsung drive, try to replace it with another Samsung). But no, I don’t think you’ll be banned, the only way to get banned by messing with the DVD drive is if you flash the DVD drive with hacked firmware and play burned Xbox 360 games on it. Just make sure that your new drive wasn’t hacked to play burned games and don’t play burned games on the drive and you should be alright.
