I want to do a prenuptial agreement w/ the man I am marrying very soon. I do not have many assets now but I’m getting inheritance. My fiance is not a citizen – he is an illegal alien from Honduras & after we get married I am going to petition to get him to become a permanent resident and for an adjustment of his status. However, I read online that if I petition for my fiancĂ© to become a permanent resident that I am required to sign an affidavit of support promising to support him up to 125% of the federal poverty guidelines. It also said that this federal support obligation supersedes any state law or any agreement between the parties. Will our prenup be valid?
