Will a baby born in England be of British nationality, despite being from foreign parents?

It depends on the parents status. If they are both foriegn and have no blood relatives who are British then; They both hold UK Passports – child will be British They have indefinate leave to remain in the UK – child will be British They have “working visas” – child will be registered as their nationality and they will have to put the child on their passports. They are illegal – the child will not be regarded as British. HOWEVER if illegal imigrants with children born in the UK are caught and deported there are some countries that WILL NOT take the child/children. This is not widely known and often denied, however I am aware of several cases where parents have been deported and the host country has refused to take their children. This causes huge problems as you can imagine.

No. The child has a right to citizenship only in its parents’ country of citizenship. Furthermore, the parents must obtain a passport for their baby immediately after it is born, then apply for permission for it to remain in the UK, depending on the parents’ legal status.

If the parents are not British or legal immigrants then the child will be of the nationality of the parents. This has always been the way and the birth should be registered with the appropriate Embassy or Consul.
