Why would someone file for Chapter 13 instead of Chapter 7 bankruptcy?
Usually, an individual chooses to file Chapter 13 bankruptcy to avoid losing their home, non-exempt automobile or other property and simply need the protection of a bankruptcy court to catch up with their payments. Other reasons include wanting to leave the option of filing for Chapter 7 open in the future, protecting co-debtors or having certain types of debts that make filing Chapter 7 impossible or complicated.
