A5. At the request of one of the defence lawyers, the Associate Chief Justice of the Quebec Superior Court granted a delay. The reason given in the motion presented by the defence was that one of the other defendants was in jail at the time, and he was unable to participate with the other defendants in the preparation for the trial. Subsequently, one of the defendants appealed to the Supreme Court of Canada in order to obtain information which he believed was important to his defense. The Supreme Court did hear his appeal on October 21, 2009. As a result, the trial for the financial recovery claim could not proceed in October 2009. The trial will likely proceed in 2010 but no date has been established yet.
