Why should an Anarchist accept the rule of law?
The rule of law makes sense as a pivot between consensus and protocol in an anti-capitalist kind of way. The rule of law also makes sense in Liberal terms as a promise to those who are ruled by representation tha they will be treated equally and that no one working for the man, as it were, will be given any exceptional treatment. In colloquial terms it simply means that no one is more equal than others. While this has some philosophical problems sometimes associated with processes of normalisation, to which I shall attend at the end of this chapter, it can be said to be a better option than the rule of men, as Aristotle termed it. But is not in itself a concept that has any serious political import. It is only as a conception in the context of a wider legal architecture that the rule of law becomes significantly related to moral, political, social and so on concerns.
