Why must the preceding procedure be rigidly followed?
The preceding procedure sets out the minimum requirements necessary for the commitment process to be constitutional under the procedural and substantive due process clause. The procedure is required by the federal court decision of Lynch v. Baxley, 386 F.Supp. 378 (M.D. Ala. 1974), rev’d on other grounds 651 F.2d 387 (5th Cir. 1981).
