Yes, they can. Any form of income, including benefits, pensions and inheritances can be taken to repay debts or monies fraudulently obtained. What needs to be clarified is whether or not the father actually did wrongfully or fraudulently claim from the (then) DHSS, what form this was, and where abouts in making a case they are. The DHSS no longer exists – is he dealing with the DSS or the DWP? Presumably he’s been notifed of what’s going on – advise him to contact a Citizens Advice Bureau to explain the situation thoroughly, get experienced eyes read through any correspondence he’s been sent, and for free legal advice.
