Why has Antonin Scalia been campaigning to overturn Roe without overturning abortion?
Overturning Roe v. Wade doesn’t make abotion illegal nationwide. It will simply mean that states are going to have to decide if they want legal abortion without any federal intervention. Like pre-Roe v. Wade days when some states like NY abortion was legal but in other states it wasn’t. Women just traveled across state lines to get the abortion. Many pro-life people want Roe v. Wade overturn on the basis that states have the right to decide this decision for themselves and in keeping with a federalist tradition. Pro-choice people see this as an attempt to curtail abortion and a impediment to women gaining access to a safe abortion. Both sides have plenty to say on this issue.
