Why does the U.S. Army Corps of Engineers (USACE) conduct munitions response actions on Formerly Used Defense Sites (FUDS)?
10USC2701 Instructs the Department of Defense (DoD) to conduct the program known as the “Defense Environmental Restoration Program” or DERP. DERP includes as one of its goals the ‘Correction of other environmental damage (such as detection and disposal of unexploded ordnance) which creates an imminent and substantial endangerment to the public health or welfare or to the environment’. DERP further instructs DoD to carry-out responses at sites which include ‘each facility or site which was under the jurisdiction of the Secretary (of Defense) and owned by, leased to, or otherwise possessed by the United States at the time of actions leading to contamination by hazardous substances’. These sites are classified as FUDS and can include private as well as public property. The USACE has been designated as the executing agency for DERP-FUDS.
