Why does the guilty plea test treat youths differently?
A. Only where a youth has admitted each and every element of the offence in a PACE compliant interview can a case be prepared as an anticipated guilty plea. Feed back from the youth courts in the test areas has shown that where youths have made a no comment interview they are far less likely to plead guilty at court than adult defendants in the same circumstances.
