Why does a parent have a financial obligation when legal custody of their child is given to the state, department, division or agency?
Utah Code Annotated 78-3a-906 requires that when a child is placed in the care or custody of the state, the court shall order the parents or any other obligated person to pay child support for each month the child is in care. Based on this law, the juvenile court judge orders the parents of the child placed in state’s custody to contribute to the support of that child no matter what the circumstances were when the child was removed from the home. Parents whose children are placed in one of the following divisions/programs are required to contribute financial support toward their child’s care.
