Why do the courts close down on unpaid leave days? Why not stagger unpaid leave?
Requiring everyone take unpaid leave at the same time is easier to implement within the constraints of the collective bargaining contracts and is a better arrangement for small clerk of court offices that have two or less employees. To minimize the impact of closures on the public, the judicial branch scheduled court closures for days that are the least busy day of the week in most courthouses. Experience from two previous times of unpaid leave (FY 2005 and FebruaryMay 2009) shows that arranging unpaid leave with court closures works reasonably well in most counties.
