Why do attorneys ask for a change of judge in a case?
It is appropriate to ask for a change of judge if the judge is related to a party, has represented a party, or otherwise has some reason to actually be biased in the specific case. Situations where this is true are limited. There are several bad reasons for asking for a change of judge. First, the attorney may want a partial and biased judge. Many attorneys and others give campaign contributions to judges in an effort to gain favor. The US Supreme Court addressed this issue but did not go as far as I go in this area. I do not solicit campaign contributions from anyone nor accept them from attorneys in order to insure a level playing field for everyone. No one has a biased judge in my courtroom due to the influence of money. Second, the attorneys may want a judge who will give them what they want rather than what is best for the parties in the case.
