If all your debts consist of unsecured debt, Chapter 7 is the route to go. However, if you are delinquent in your mortgage or car payments, you need to file a Chapter 13. There are other reasons as to why a Chapter 13 is preferable to a Chapter 7. Ask your attorney for more information.
