Why cant the local authorities undertake this strategy themselves?
The public sector cannot readily engage in land deals with developers at an early process in the light of potential, future transportation facilities. This could affect the independence of planning and is difficult within a local authoritys terms of reference. The private sector cannot do it because of confidentiality and commercial barriers. Section 106/75 negotiations are unaffected except that the transport element of any calculation made by Local Authority can not be double counted. If E-Rail has secured a form of uplift for a specific transport system the Council cannot recover a similar or other amount for the same purpose. This does not prevent the Council from raising money for other transport matters such as roads, traffic lights or pedestrian crossings.
