Why can the custodial parent provide the insurance? Does the employee have to pay for insurance if the custodial parent is already paying for it?
A9: The employee was ordered to provide health care coverage for his or her children and must abide by the terms of the court order. If either parent wants to change the terms of the order, he or she must go back to court to get the order modified. Even if the parents agree that the custodial parent should provide the insurance, they must return to court to have the order modified. Either parent can contact DOR to get help going to court to modify the order. Unless the employer receives notice that the order has been modified, the employer must begin deducting for health care and return the Notice to DOR at the address shown on the Notice.
