The rule does not allow the use of credit cards or debit cards for the direct deposit or withdrawal of funds from a lawyer trust account. Thus, a lawyer may not have a client pay an advance on fees by having the credit card payment posted directly to the lawyer trust account. There are two reasons for this: (1) the charge for use of a credit card comes off of the deposit so the client is actually paying less than the total amount into the trust account; and (2) some credit card companies are allowed to reclaim the monies that are deposited into that account if the cardholder disputes the charges made.
