Why aren warrants for DNA collection a violation of 5th amendment guarantees?
The 5th amendment guarantees your trial right to not incriminate yourself in a criminal trial. It applies to incriminating *testimony*, and since a DNA warrant allows for the collection of physical evidence, it cannot violate a testimonial right in the same way that someone observing you wiping blood from a murder weapon, an incriminating action, can’t be kept out of court on 5th amendment grounds.
