first off you have to look at what happened in the past. In the past they didn’t have DNA analysis so most law enforcement agencies don’t save evidence for that long and usually only save it till the end of sentencing.If they don’t have DNA from the crime scene when the crime was committed then they can not rule that person out as a suspect because they can not match the crime scene DNA to the suspect/inmates DNA and there for they are on death row because there is no way to prove whether they were or were not involved but more then likely they were or the other facts give a high suspicion that they were or placed them at the scene of the crime or around that area when it did happen.
