There is a problem of perception with the public rather than a real one in the system. There are two major types of “life” sentence in England. The first is the “mandatory” life sentence given for murder. This sentence, as its name suggests, is mandatory on conviction, and the judge must impose a life sentence. The other is the “discretionary” life sentence. Some offences can carry a life sentence, but it is not mandatory, it is up to the judge. These offences include manslaughter, rape, kidnap, arson, and some other offences. In all cases the judge must specify a “minimum tariff”. This is the absolute minimum which must be served before a prisoner can apply for parole. It does NOT mean that the prisoner will actually get parole, and in reality life sentences are indeterminate in this respect.
