Why are there two sets of right-of-way regulations in the final rule?
The regulations at 43 CFR Part 2800 – “Rights-of-Way, Principles and Procedures”, apply to rights-of-way issued under FLPMA, such as electric transmission lines, water pipelines and some roads. The regulations at 43 CFR Part 2880- “Rights-of-Way Under the Mineral Leasing Act”, apply to rights-of-way issued for oil and natural gas pipelines and related facilities.
