Actually in a lot of states the age of consent is 16 but the partner must still be within a certain age such as 2 years from the age of the minor. For instance my husband is 5 years older than me. When i was 17 he was 22 and still eligable to be charged with statutory rape of a minor because he was a legal adult and I was not. In my state a 16 year old can consent to sex with a partner up to age 18. And the reason most people become confused is because the laws vary from state to state and the age of the person they are having sex with changes the laws in many states.
