Why a special needs trust?
Some trusts are court-ordered, as part of a structured settlement. Others can be created for the benefit of someone with special needs. A problem can arise if someone leaves money directly to a person with special needs, since this can result in the termination of any eligible government or local benefits and services for that person. For this reason, a trust is the preferred mechanism to help someone with a special need live their fullest life, and to help families cope with overwhelming amounts of specialized care or routines that may be necessary now or in the future.
