Whos responsible for negligent tree trimming?
A and his neighbor (B) together hired a tree trimmer. They got the permission of their down-the-hill neighbor (C) to cut his trees as well. C gave permission for tree trimmer to access his yard and cut his, A’s and B’s trees. A and B paid for all the work and all the trimmings were removed through C’s yard. Subsequently the trimmed trees died, presumably as a result of negligent trimming. Months later, C has now threatened to sue A and B if they do not pay for the removal of all the dead trees. He claims the tree trimmer was A and B’s agent and that A and B were responsible for the damages resulting from negligent cutting of his trees. Is C responsible for any share of the damage since he gave permission? Assuming the tree-trimmer is judgment-proof and negligent, who’s liable?
