Who will enforce the smoking bans?
• In general most of the legislation is expected to be self-enforcing as the community becomes aware of its obligations. • Occupiers of premises have certain responsibilities to ensure that people do not smoke in smoke free areas. • Department of Health and Human Services staff and nominated officers will be responsible for enforcing smoking bans in hotels, cafes and restaurants. A complaints based approach will be used. • Department of Health and Human Services staff will not routinely monitor smoking in public places or workplaces, but will respond to complaints. • Prison Officers are expected to enforce the bans in prisons. • Nominated officers, empowered under the Public Health Act 1997 to enforce the legislation include Environmental Health Officers, Police and persons nominated by the Director of Public Health, who may include Licensing Inspectors, Prison Officers, or Tobacco Control Officers. • Council Environmental Health Officers are empowered to enforce the legislation.
