Who will be appointed as an ombudsman and how is the person paid?
Both patient care and consumer privacy ombudsmen must be disinterested persons, who are not the United States Trustee. If the debtor is a long-term health care facility, the United States Trustee may appoint the State Long-Term Care Ombudsman appointed under the Older Americans Act of 1965. Ombudsmen are paid like any other professional. Pursuant to 11 U.S.C. ยง 330, ombudsmen can be paid reasonable compensation for actual, necessary services rendered and reimbursed for actual, necessary expenses.
