Who said no state can lawfully get out of the union?
Abraham Lincoln in his first inaugural address said: “No state upon its own mere motion can lawfully get out of the union.” Is this true? Have the States that were once undeniably sovereign states, surrendered their right to sovereignty? It doesn’t even take a careful reading of the 10th Amendment under the Bill of Rights in the Constitution of the United States of America to know that Lincoln was, as a point of law, in error. That his actions as Commander and Chief were motivated by his belief that he was correct does not change the fact that he was acting outside of the authority granted him by the people. This is not to be misunderstood as a slave state advocacy. The “three-fifths” compromise woven into the Constitution is the fatal tragic flaw of all that followed. The Constitution itself condoned slavery and went into agreement that some people did not have the same rights as others.
