Who pays the cost of the eviction?
Sec 83.251 FSA (non-residential) and Sec 83.48 FSA (residential) and most leases provide that the prevailing party in a suit may recover costs from the other. The problem is that a prevailing landlord may find it difficult to recover costs from tenants who otherwise have no assets or resources from which to repay those costs. Because of this, we believe that landlords who act quickly when a tenant fails to pay rent can usually minimize, or even eliminate, the out of pocket costs + fees incurred in an eviction by covering those moneys from the tenant’s security deposit.
