Who pays for the Arbitration or Mediation?
This is usually the subject of agreement among the parties. With Mediation, the parties generally share the costs equally. With Arbitration, the parties can agree to split the costs evenly, they can choose to have the Arbitrator award costs to the prevailing party, or they can elect to have the Arbitrator exercise his discretion. Again, no matter who is paying, the costs to all parties are generally only a small percentage of what fees and costs would otherwise be for court litigation.
